Welcome to Studious! These Terms of Service (“Terms”) govern your use of the Studious mobile application and web platform (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our Services.

1. Subscriptions and Free Trials

• Subscription Fee: Studious offers a subscription service for $29 per month (the “Subscription Fee”) following a 2-week free trial period (the “Trial Period”). The subscription currently covers access to the Studious mobile application. Future updates may include access to a web version under the same subscription.
• Trial Period: To begin the Trial Period, you must provide valid payment information. The Trial Period will last for 14 calendar days starting from the time of subscription initiation.
• Conversion to Paid Subscription: If you do not cancel your subscription before the end of the Trial Period, your subscription will automatically convert to a paid subscription, and the Subscription Fee will be charged to your payment method on file.
• Cancellation: You are free to cancel your subscription at any time through the Apple payment settings on your device. Cancellation will prevent any further charges but will not result in a prorated refund for the current subscription period.
• No Refund Policy: Studious does not offer refunds for any previous months. This includes partial months of use or unused services during the subscription period. Upon cancellation, access to premium features will continue until the end of the current billing cycle.

2. User Responsibilities

• Account Information: You are responsible for maintaining the confidentiality of your account login credentials and ensuring that any information you provide to Studious is accurate and up-to-date.
• Acceptable Use: You agree to use the Services in compliance with all applicable laws and regulations. You may not misuse the Services or their features, including but not limited to reverse engineering, unauthorized access, or engaging in fraudulent activity.

3. Modifications to the Service and Pricing

• Changes to Pricing: Studious reserves the right to modify its subscription pricing at any time. However, any price changes will only take effect at the start of the next billing cycle and you will be notified in advance.
• Changes to the Service: We may update, alter, or discontinue features or functionalities within the mobile application or web platform at any time. We will strive to communicate any significant changes to you in advance.

4. Termination

• By You: You may cancel your subscription at any time, effective at the end of the current billing period.
• By Studious: We reserve the right to suspend or terminate your account and access to the Services at our discretion, including for violations of these Terms or for inactivity over an extended period.

5. Intellectual Property

• All content, software, and materials made available through Studious are owned by Studious and are protected by intellectual property laws. You are granted a limited, non-transferable license to access and use the Services for personal, non-commercial purposes.

6. Disclaimer of Warranties

• Studious provides its services on an “as is” basis and does not warrant that the Services will be error-free or uninterrupted. To the maximum extent permitted by law, we disclaim any implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

• In no event shall Studious or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our liability is limited to the amount you have paid to Studious in the past 12 months.

8. Governing Law

• These Terms are governed by and construed in accordance with the laws of the State of New York, USA. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts located in New York, New York, USA.

9. Changes to Terms

• Studious may revise these Terms from time to time. We will notify you of any material changes through the App, web platform, or via email. By continuing to use the Services after changes are made, you agree to be bound by the revised Terms.
